Charges Temporarily Dismissed Against FDU Professor Accused in Prostitution Ring

Prosecutors say they plan to re-file charges as investigation continues.

Prosecutors in New Mexico have temporarily dismissed charges against Professor David Flory while computer experts continue to search through the online prostitution ring he allegedly helped run, according to authorities and news reports.

In June, a website they said linked johns with prostitutes. Police said the site involved 200 female prostitutes and 1,200 johns, and it was possible Flory accessed the site from his campus office. State police searched the Teaneck office and federal agents were assisting in the computer forensics, authorities said. 

Charges including promoting prostitution have been temporarily dropped against Flory and co-defendant  police alleged was involved with the site, the Albuquerque Journal reported Friday.

Prosecutors said they plan to re-file the charges, and the move takes them off a 60-day timeline to get an indictment, the newspaper reported.

“It's not uncommon for this to occur, especially with court cases that contain a great deal of evidence to sort through,” said Bernalillo County District Attorney’s Office spokeswoman Kayla Anderson. “The investigation is still very active.”

Flory, 68, ran the site as a hobby and did not profit from it, investigators have told Patch. An attorney for Garcia has questioned the charges against him and others accused in the case because there is no evidence they profited from the site, according to the Albuquerque Journal.

Flory and his attorney could not be immediately reached. 

After his arrest, Fairleigh Dickinson University said Flory was put on a leave of absence. He had been released on bond and ordered to stay in New Mexico, however, the recent legal move has no conditions of release, Anderson said. 

Flory lived part-time in Santa Fe and with his wife in Manhattan.
