Manhattan Man Charged in Teaneck Murder Refuses to Waive Extradition

The New York City man in the killing of a Teaneck software engineer will face a hearing later this month after he refused to waive extradition to New Jersey, according to the Manhattan District Attorney's Office. 

Sui Kam Tung, 49, was arrested Friday at his Upper East Side apartment more than a year after the murder of Robert Cantor. 

When a defendant opts to fight extradition, prosecutors seek a  "governor's warrant" to have the accused returned to face charges, the Manhattan District Attorney's Office said. The process involves the governor of New Jersey sending a request to the governor of New York. 

Tung's extradition hearing is scheduled for May 31, according to the District Attorney's Office. 

New York State court records showed Tung was being represented by a legal aid attorney. The attorney for Tung could not be reached for comment Monday night. 

Meanwhile, Tung agreed Monday to a restraining order barring him from any contact with his wife and three young children. 

Among provisions of a three-year protective order, Tung is barred from going to the home or workplace of his wife and blocked from calling his wife or children, northjersey.com reported. 

Bergen County authorities have said Tung began stalking Cantor in 2010 after he learned the Elm Avenue resident was having an affair with his estranged wife. Tung confronted Cantor at his home in March 2011, when Cantor was , prosecutors said. 

In addition to murder and arson, Tung faces charges of felony murder, armed burglary, desecration of human remains, possession of a handgun for an unlawful purpose, unlawful possession of a handgun, hindering apprehension, evidence tampering and stalking. 

He was being held on $3 million bail at the Manhattan Detention Complex.
